Terms and Conditions
These Terms and Conditions ("Terms") govern the use of the website and the availing of any service - including air ticketing, tour packages, visa services, forex services, and travel insurance facilitation (collectively, "Services") - offered by White Falcon Pvt Ltd ("White Falcon", "the Company", "we", "us", "our"), a company engaged in travel and immigration services with its principal place of business in Sangrur, Punjab, India. By accessing the website, making a booking, or availing any Service, the customer ("Customer", "you", "your") agrees to be bound by these Terms.
1. Definitions
- "Services" means air ticketing, tour package booking, visa application facilitation, forex exchange facilitation, travel insurance facilitation, and any other travel or immigration-related service offered by the Company.
- "Third-Party Service Provider" means any airline, tour operator, hotel, visa processing agency, embassy or consulate, foreign exchange authorised dealer, or insurance company whose products or services are booked or facilitated through the Company.
- "Booking" means a confirmed request for any Service made by the Customer, whether online, in person, or through any other mode accepted by the Company.
2. Nature of Services
White Falcon acts as a travel agent, booking intermediary, and facilitator between the Customer and Third-Party Service Providers, including airlines, tour operators, hotels, visa processing authorities, foreign exchange authorised dealers, and insurance companies. Except where the Company itself directly renders a service, the Company does not own, operate, or control the Third-Party Service Providers, and all bookings are subject to the terms, conditions, fare rules, and policies of the relevant Third-Party Service Provider in addition to these Terms.
3. Booking and Payment
All bookings are subject to availability and confirmation. Prices quoted for flights, tour packages, visa services, forex, or insurance are indicative and subject to change without prior notice until full payment is received and the booking is confirmed in writing. The Customer shall provide accurate and complete information, including full legal name as per passport, date of birth, passport number and validity, and contact details, at the time of booking. The Company shall not be liable for any loss, denial of boarding, denial of visa, or other adverse consequence arising from incorrect or incomplete information provided by the Customer.
Full or partial advance payment may be required to confirm a Booking, as communicated at the time of booking. The Company reserves the right to cancel a Booking where payment is not received within the stipulated time.
4. Air Ticketing
Air tickets are issued subject to the fare rules, baggage policy, cancellation policy, and conditions of carriage of the respective airline, which are outside the Company's control and may change without notice. The Company facilitates the booking but is not responsible for flight delays, cancellations, rescheduling, denial of boarding, loss of baggage, or any other act or omission of the airline. Airfares are dynamic and subject to change until full payment is received and the ticket is issued.
5. Tour Packages
Tour package itineraries, inclusions, and exclusions shall be as specifically communicated to the Customer in writing at the time of booking. The Company reserves the right to modify an itinerary due to circumstances beyond its control, including weather, local disruptions, transport delays, or force majeure events, and shall make reasonable efforts to arrange suitable alternatives. Tour packages are subject to the terms and conditions of the underlying tour operator, hotel, and transport providers.
6. Visa Services
The Company provides visa application facilitation services, including guidance on documentation, form-filling assistance, and submission support. The Customer expressly acknowledges and agrees that:
- The grant, refusal, or delay of any visa is at the sole discretion of the concerned embassy, consulate, or immigration authority, and the Company has no control over and does not guarantee the outcome of any visa application.
- The Company's service fee is charged for the facilitation service rendered and is non-refundable regardless of the outcome of the visa application, including in the event of rejection, delay, or withdrawal.
- Government/embassy fees, once paid or submitted to the relevant authority, are non-refundable and non-transferable, except to the extent refunded by the concerned authority itself.
- The Customer is solely responsible for the genuineness, accuracy, and completeness of all documents submitted, and the Company shall not be liable for any consequence, including visa rejection, arising from false, incomplete, or inaccurate information or documentation provided by the Customer.
7. Forex Services
Foreign exchange services are facilitated in accordance with the guidelines of the Reserve Bank of India (RBI) and applicable Foreign Exchange Management Act (FEMA) regulations, through authorised dealers/partners. Exchange rates are subject to market fluctuation and shall be the rate prevailing at the time of the actual transaction, not the rate indicated at the time of enquiry. The Customer shall furnish valid KYC documents (identity proof, address proof, PAN, travel documents, and any other document required under RBI/FEMA guidelines) as a precondition to availing forex services.
8. Travel Insurance
The Company acts solely as an intermediary/facilitator for travel insurance products issued by third-party insurance companies and is not itself an insurer. All claims, coverage terms, exclusions, and conditions are governed exclusively by the policy document and terms of the concerned insurance company. The Company shall not be responsible for the rejection, delay, or quantum of any insurance claim, which shall be determined solely by the insurer in accordance with the policy terms.
9. Fees and Service Charges
The Company's service charges are separate from and in addition to the cost of the underlying product (airfare, package cost, visa/government fees, forex margin, or insurance premium) and shall be as communicated to the Customer prior to confirmation of Booking. Service charges are non-refundable once the corresponding service has commenced, except as otherwise stated in the Cancellation and Refund Policy.
10. Client Responsibilities
The Customer is responsible for ensuring that their passport, visa, and other travel documents are valid and meet the requirements of the destination country and airline at the time of travel, including minimum passport validity requirements. The Customer is responsible for arriving at the airport, port, or other departure point within the time communicated by the Company or the relevant Third-Party Service Provider.
11. Limitation of Liability
To the maximum extent permitted by law, the Company's aggregate liability for any claim arising out of or in connection with a Service shall be limited to the service fee actually paid by the Customer to the Company for that specific Service, and shall not extend to the cost of the underlying product or to any indirect, incidental, or consequential loss, including loss of holiday enjoyment, loss of business, or loss arising from denial of visa, boarding, or insurance claim.
12. Force Majeure
The Company shall not be liable for any failure or delay in performance arising from circumstances beyond its reasonable control, including natural disasters, pandemics, government restrictions, airline or airport disruptions, embassy closures or policy changes, strikes, or civil unrest.
13. Intellectual Property
All content on the Company's website, including text, images, logos, and design, is the property of White Falcon Pvt Ltd or its licensors and may not be reproduced, copied, or used without prior written consent.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Subject to applicable law, the courts at Sangrur, Punjab shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Services.
15. Grievance Redressal
Any complaint or grievance regarding the Services may be addressed to the Company's designated contact point, as published on the Company's website, and the Company shall endeavour to resolve the same within a reasonable time.
16. Amendments
The Company reserves the right to modify these Terms at any time. Continued use of the website or Services after such modification constitutes acceptance of the revised Terms.
17. Acceptance
By making a Booking, making payment, or using the Company's website or Services, the Customer confirms having read, understood, and agreed to these Terms and Conditions.
